- ✔Holiday hours beyond 8 get the 100% holiday premium, not the overtime premium (Article 56(2)).
- ✔Workplaces with fewer than 5 employees owe no premium, but must still pay 1.0x wages for all hours worked.

Q. When does night work premium apply?
Work performed between 10pm and 6am earns a 50% premium on ordinary wages at workplaces with 5 or more regular employees, including shift workers scheduled in that window.
Q. What if I work a night shift on a holiday?
Premiums stack. Holiday work within 8 hours that overlaps night hours pays 100% (base) + 50% (holiday) + 50% (night) = 2.0x ordinary wage; holiday hours beyond 8 that overlap night pay 2.5x.
Q. Can I receive both overtime and night premiums?
Yes. Overtime (beyond 8 hours/day or 40 hours/week) and night work (10pm-6am) are separate premium grounds. Overtime extending past 10pm earns 50% + 50% = 2.0x ordinary wage.
Q. My workplace has fewer than 5 employees and paid no night premium — is that legal?
Article 56 premiums do not apply to workplaces with fewer than 5 regular employees, so unpaid premiums alone are not unlawful there. However, 1.0x wages for all hours worked and minimum wage still apply.
